General Terms & Conditions


The various provisions of this contract “Charter Order” shall come into force, and the client’s order to “PrivatecharterX” to book an aircraft for him shall be deemed to have been given when the charter client makes the booking by e-mail or telephone. If the contract is not signed or returned by the client, this shall not be deemed as a lack of consent. The final confirmation of the aircraft by the selected airline can only be made after the receipt and return of the signed contract by e-mail. Delays in sending the signed contract cannot be blamed on “PrivatecharterX” if the aircraft is no longer available at the time of receipt of the final booking confirmation.

Any cancellation after the written confirmation of the booking by e-mail or telephone will incur a minimum penalty of 30% in accordance with the conditions set out in Article 7. Any change of aircraft requested by the Client after confirmation of a specific aircraft may result in the cancellation charges set out in Article 7 below if the airline of the aircraft first confirmed is unable to provide an aircraft from its fleet to match the new booking request or if it has to change its charterer to match the Client’s new booking request for the requested aircraft.

ARTICLE 2: FLIGHT CHANGES
This Charter Agreement cannot be extended or amended until the Client has received the consent of “PrivatecharterX”. “PrivatecharterX” shall give all necessary instructions to the crew or subcontractor. Except in urgent or exceptional circumstances, the Crew shall not be authorized to take instructions from the Client. Any amendment to this contract will result in additional billing, credit, or deduction in accordance with the applicable tariff. The carrier is responsible for the proper performance of the contract.

ARTICLE 3: FLIGHT SCHEDULES – DIVERSIONS – CANCELLATIONS
The departure and arrival times indicated and approved by the Client are purely indicative. “PrivatecharterX” or the subcontractor reserve the right to modify them or to cancel all or part of the flight for safety, traffic or weather reasons or for technical or licensing reasons. In case of unavailability of the aircraft for technical reasons before or during the flight, “PrivatecharterX” cannot be held liable. “PrivatecharterX” will endeavor, together with the airline, to find a replacement aircraft of the same or smaller size if this is possible. Any additional costs not borne in accordance with the subcontractor’s terms and conditions shall be borne by the client, who shall accept them accordingly.“PrivatecharterX” or the Carrier shall not be liable for any damages, losses, or lost profits incurred by the Charter Company or the Passengers as a result of the flight not being able to be operated as scheduled due to force majeure, including, but not limited to, imposed quarantine, aircraft breakdown, civil unrest, airport strikes preventing the departure of the aircraft, riot, threat of war, or due to other natural disasters (force majeure).

The airline is not liable for any damage, loss, or delay caused by airport employees or persons who are not under the supervision of the airline or “PrivatecharterX”. Helicopter flights will be refunded without cancellation fees if weather conditions do not allow the flight to be operated from the aircraft base. If the aircraft is made available for the requested flight at a location or departure point other than the base, only the cost of making the aircraft available at the base and the return journey will be charged.

ARTICLE 4: INSURANCE
The Carrier shall insure its aircraft in accordance with the general conditions of the Montreal or Warsaw Convention, depending on the company.

ARTICLE 5: REQUIRED IDENTIFICATION DOCUMENTS
In the context of anti-terrorism measures, it is mandatory to provide “PrivatecharterX” with scanned copies of passengers’ identity documents 48 hours before the flight. Otherwise, the authorities may refuse carriage and impose a fine of up to CHF 5,000 per passenger.

ARTICLE 6: PAYMENT TERMS AND CONDITIONS
The balance shall be paid in accordance with the terms of the charter contract or 14 days prior to departure. For same-day flights, payment must be made by cheque or bank transfer before boarding.A change of airline after written confirmation and conclusion of a contract with a subcontracted airline may result in cancellation fees on the part of the subcontracted airline if the flight is cancelled for an aircraft with a seating capacity other than that offered, which it does not have, or if the customer decides to cancel the return flight with the same airline for any reason on the part of the customer or the airline itself for technical reasons.As a reminder of the General Terms and Conditions: Invoices are payable on receipt, unless special arrangements have been made. If the payment deadline is exceeded, a late payment surcharge of three times the statutory interest rate will be levied on the amount, including VAT pro rata temporis in accordance with Article 53 of the Swiss Code of Obligations (CO).The rate of interest for late payment due from the day following the date of payment indicated on the invoice must be indicated on the invoice (Article 104 CO).

ARTICLE 7: CANCELLATION PERIODS
The time between the date of confirmation or cancellation and the date of departure of the flight:Amount payable to “PrivatecharterX”:More than 60 days before the date of departure: 30%.From 60 to 30 days before the date of departure: 40%.From 30 days to 7 days before the departure date: 50%.From 48 hours to 0 hours before the departure date: 100%.In the event of refusal to pay the cancellation fee due, 100% of the cancellation fee will be charged, plus court costs.

ARTICLE 8: DELAYED EMBARKATION
Passengers must be ready to board between 2 hours and 20 minutes prior to departure time, depending on the information provided in the flight schedule and the confirmed aircraft type. For delays caused by passengers, the customer is liable to the airline if the latter has to pay additional airport charges or if this causes a delay to the subcontractor’s subsequent flight; these costs are borne by the customer.

ARTICLE 9: BAGGAGE
The maximum weight allowed per person on business aircraft is 10/15 kg (for standard size) and up to 20 kg on wide-body aircraft. Passengers are advised to carry a soft baggage item in fully loaded small business aircraft. “PrivatecharterX” or the subcontractor cannot under any circumstances be held liable for excess baggage or baggage whose dimensions do not allow it to be carried. Also for loss and damage to baggage caused by the negligence of passengers.

ARTICLE 10: FUEL AND DE-ICING ALWAS INCLUDED
The Fuel Price as well the De-icing service are included in the Final Prices. The Prices shown on the Website are Basic Prices without any additional Service Prices like Catering ecc. but including Fuel & De-Icing.

ARTICLE 11: PET FRIENDLY & PET-TRANSPORT
The customer is entitled to transport one or more pets (hereinafter "Animals") as part of their private jet charter service, subject to prior agreement with the Provider.

The customer is obliged to submit all necessary documents for the transport of their animals before the journey, including but not limited to vaccination certificates and health records.

The Provider reserves the right to refuse the transport of animals if required by applicable regulations or safety requirements or if it could endanger the well-being of the animals.Animal Welfare and Safety

The Provider undertakes to ensure the safety and well-being of the transported animals throughout the entire flight.

The customer is obliged to provide all necessary information about the behavior and needs of their animals before the trip to ensure safe transport.Liability

The Provider is not liable for injuries, illnesses, or the loss of animals during transport if such incidents are attributable to factors beyond the control of the Provider.

The customer is liable for any damages caused by their animals during the flight to the private jet's equipment or third-party property.Booking and Cancellation

Pet-friendly private jet charter services must be booked in advance, and availability is subject to the Provider's approval.

In the event of a cancellation, the Provider reserves the right to charge reasonable cancellation fees as per the agreed terms.Final Provisions

These T&C apply to all pet-friendly private jet travels between the customer and the Provider.


ARTICLE 12: EMPTY LEGS
PrivatecharterX plays a pivotal role in this process, serving as a platform that connects travelers with a myriad of Empty Leg flight options. It's important to emphasize that PCX acts solely as a facilitator and does not assume any responsibility for the aircraft, its operations, or the safety of the journey. All responsibility lies with the registered and reputable airline companies providing the Empty Leg flights.

ARTICLE 13: DISPUTES
The court of Lugano, Switzerland, shall have jurisdiction over any dispute relating to the interpretation or execution of this contract.
